These terms of service govern the contractual relationship between PITAMETERNAM EURL (hereinafter "the Seller") and any individual or legal entity (hereinafter "the Customer") wishing to purchase the WordPress plugin "Easy Content Linker".

Article 3 - Products and Pricing
The Easy Content Linker plugin is available as an annual license according to the following plans:

Article 4 - Orders
Orders are placed through the secure Freemius payment platform. The Customer acknowledges having read these Terms of Service before validating their order.
Article 5 - Payment
Payment is made by credit card or PayPal via Freemius. The order is confirmed after payment validation. Renewal is automatic unless canceled by the Customer.
Article 6 - Delivery
The plugin is delivered via immediate download after payment. The Customer receives an email containing the download link and their license key.
Article 7 - Right of Withdrawal
In accordance with digital content regulations, the right of withdrawal does not apply to digital content provided on an intangible medium whose execution has begun with the consumer's agreement.

Article 8 - License of Use
The purchase grants a non-exclusive and non-transferable license of use. The Customer agrees not to redistribute, resell or share the plugin or its license key.
Article 9 - Support and Updates
The annual license includes access to updates and technical support for the duration of validity. After expiration, the plugin remains functional in free mode but without access to new versions or support.
Article 10 - Liability
The Seller shall not be held liable for indirect damages resulting from the use of the plugin. The Customer remains responsible for their OpenAI API usage costs.
Article 11 - Personal Data
Collected data is processed in accordance with GDPR. For more information, see our privacy policy.
Processing on behalf of the Customer (Article 28 GDPR). When the Customer uses the plugin, the Seller processes on the Customer's behalf, as a processor, the content of the Customer's articles (which may contain personal data) solely to provide the service: computing embeddings and selecting anchors. The Customer remains the controller of its content. Accordingly, the Seller:
- processes this content only on the Customer's instructions, that is to run the plugin, and uses it for no other purpose;
- does not keep this content after each request is processed, and transmits it encrypted (HTTPS);
- sends this content to OpenAI using the Customer's own API key, the Customer being an OpenAI customer bound by OpenAI's terms; the list of other processors is given in the privacy policy, and the Customer is informed of any change;
- ensures that persons authorized to process the data are bound by confidentiality and implements appropriate security measures;
- notifies the Customer of any personal data breach affecting it without undue delay, and at the latest 48 hours after becoming aware of it;
- assists the Customer in responding to data subject requests and makes available, on request, the information needed to demonstrate compliance with these obligations;
- deletes, at the end of the contract or on request, the technical data relating to the Customer's site (domain, token, license information), subject to legal retention obligations.
Article 12 - Applicable Law
These Terms of Service are subject to French law. In case of dispute, an amicable solution will be sought before any legal action. Failing that, French courts shall have jurisdiction.
